Your use of this Website & Contact Me App, as a user (referred to as "You"), is subject to the terms and conditions outlined below ("Terms of Use"). Market India Services Private Limited reserves the right to modify these Terms of Use at any time without prior notice. If any User fails to comply with any of the Conditions, Contact Me reserves the right, but not the obligation at its own discretion, to withdraw the User Account in question and suspend or withdraw all Services to that User without notice. 1-cModification of Terms, Updates to App Features
ContactMe reserves the right to modify the Terms of Use at any time. In addition, ContactMe may vary or amend the services provided through the app, the app functionality, and/or the overall user experience at any time without prior notice and without liability to users.
Any modifications to the app, services, or Terms of Use will become effective immediately upon being published on the app. Users will be notified of any material changes to the Terms of Use via email.
By continuing to use any services offered through the ContactMe app following the publication of any modified Terms of Use, users will be deemed to have accepted the updated conditions.
- SERVICE USAGE
2-aUser Account Setup and Data Accuracy
To access the services offered by ContactMe, each user must create a user account and provide the requested personal information. This includes your first name, last name, email address, and valid mobile number.
By creating a user account, members agree that all information provided to ContactMe must be true, correct, complete, and accurate at all times. This includes information provided during account setup and any updates made thereafter. Additionally, members agree that any information supplied to ContactMe or posted on the platform will be truthful, accurate, and complete.
Users also acknowledge and accept that all information provided during account setup and at any other time must be true, correct, complete, and accurate. Users further agree that any information supplied to ContactMe will be truthful, accurate, and complete.
Unless explicitly permitted by ContactMe, users are restricted to one user account per individual. User accounts cannot be created on behalf of another person or for the purpose of impersonation. Additionally, user accounts cannot be created using incorrect vehicle registration information that does not belong to the user.
2-bCommercial Activity Prohibition and ContactMe's Identity
The ContactMe App and its Services are exclusively designated for individuals as Vehicle or Belongings owners/drivers and members of the public, intended for personal use only. They may not be utilized for any commercial or professional purposes. The Services are strictly for registering one's own vehicle or belongings details, uploading relevant documents, such as a valid registration proof or license, and setting periodic reminders. Furthermore, users may utilize the Services solely for contacting vehicle or belongings owners or contacts in cases of valid emergencies or reasons.
2-cCommunicating with Users
By accepting these terms, users consent to receive communications from ContactMe via phone calls, SMS, email, notifications, or other means deemed appropriate by ContactMe. Such communications to Users may be recorded through technical support provided by third parties for the purpose of training, quality and for regularly updating the Users about the services of ContactMe.
- RELEASE AND HOLD HARMLESS
Users of ContactMe agree to indemnify and hold harmless Market India Services Pvt. Ltd., its subsidiaries, affiliates, and their respective officers, directors, agents, and employees from any claim, demand, or actions, including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of the user's breach of these Terms of Use or any document incorporated by reference, or violation of any law, rules, regulations, or the rights of a third party.
Users release Market India Services Private Limited and/or its affiliates, and/or any of its officers and representatives from any cost, damage, liability, or other consequence of any of the actions or inactions of the users and specifically waive any claims or demands that they may have in this regard under any statute, contract, or otherwise.
By using ContactMe, users acknowledge and agree to these indemnification and release terms. If you do not agree to these terms, please refrain from using ContactMe.
- UNIVERSAL TERMS
4-aAssociation with Users
No association between the Users and ContactMe shall infer or be construed as an agency, partnership, joint venture, or any similar relationship between the Users and ContactMe.
4-bInterruption or Termination of Access
Should you fail to comply with any or all of the specified conditions, please be aware that ContactMe retains the authority to suspend or terminate, either temporarily or permanently, all or part of the service or your access to the app, including but not limited to your user account, without prior notice.
4-cProtection of Intellectual Property
The content and design elements within the ContactMe App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Market India Services Pvt. Ltd., its affiliates, or its content providers, and are safeguarded by applicable copyright, authorship, and database laws in India.
All rights pertaining to registered and unregistered trademarks featured within the App, whether owned or licensed by Market India Services Pvt. Ltd., are reserved.
No part of the ContactMe App, or its components, may be reproduced, duplicated, copied, sold, resold, visited, or exploited for any commercial purposes without the explicit written consent of Market India Services Pvt. Ltd. Unauthorized extraction or reuse of any content within the App is strictly prohibited, including the use of data mining, robots, or similar automated tools, without prior written authorization from Market India Services Pvt. Ltd.
4-d Content Provided by Users
By contributing content to the ContactMe App, Users explicitly grant ContactMe a license to display, distribute, and utilize the content for various business purposes, ensuring the smooth operation of our services. However, Users are reminded of their responsibility to ensure that the content they share does not contain any defamatory, misleading, or offensive material, nor does it infringe upon the intellectual property rights of others, such as copyright violations.
In the event that any User violates these guidelines, ContactMe disclaims any liability associated with such content and holds the User personally responsible for any resulting damages or liabilities. Users agree to indemnify ContactMe against any claims arising from their content and commit to promptly removing any infringing material upon notification by ContactMe. Our platform is dedicated to maintaining a respectful and lawful environment for all users, and we take swift action to address any instances of misconduct or infringement.
4-eAssociated Platforms
ContactMe retains the authority to utilize any information showcased within the app or its associated platforms.
Moreover, advertisements featured on ContactMe or its affiliated platforms may be replicated on other platforms managed by ContactMe itself or in collaboration with third-party partners. This allows for wider dissemination of relevant content and services across various channels for enhanced user engagement and convenience.
- WARRANTY AND LIABILITY
Market India Services Private Limited disclaims any warranties and limits liability as outlined in the Privacy Policy and Disclaimer.
- LEGAL JURISDICTION AND GOVERNING LAW
These Terms of Use are governed by Indian law, and any disputes shall be subject to the jurisdiction of the courts of Ahmedabad.
